Child Custody Requirements for U.S. Immigration

Our firm obtains Thailand Family Court awards of sole custody for the children of our clients enabling your fiancee or spouse to immigrate her child or children to the United States by satisfying the specific requirements of the United States Department of Homeland Security and U.S. Department of State.

An award of sole custody from the Thailand Family Court satisfies the laws of the United States, and the laws of Thailand enabling the Thai parent to obtain the U.S. immigrant visa for their child.

Child Custody is required:

A) To obtain a Thai passport for a Thai child both parents must participate in the application process, unless a single parent can provide evidence of sole custody or the death certificate of the other parent.

B) If a Thai parent attempts to take a Thai child outside of Thailand a Thai Immigration Police officer at a port of departure, typically an airport, will require a single traveling parent to produce evidence of sole custody, the death certificate of the other parent, or a properly executed, attested, and certified authorization of consent from the non-traveling parent consistent with the visa type the child is traveling on.

C) When immigrating a Thai child to the United States the laws of the United States and policies of the United States Department of State and Department of Homeland Security apply. When obtaining child custody in Thailand one must work within the laws of Thailand and with the Thai legal system in such a way as to satisfy the laws of the United States and the polices of the Department of State and the Department of Homeland Security.

The award of sole custody from the Thailand Family Court enables a single parent to:

1. Obtain a Thai passport for a Thai child.

2. Enables a single traveling parent to submit the proper documentation to the Thailand Immigration Police at the port of departure of his/her parental authority.

3. Satisfies the requirements of the Department of Homeland Security of the parent’s parental authority when adjusting the child’s status to that of legal permanent resident after arrival in America.

4. Allows the parent to authorize medical treatment of the child in the United States.

5. Expedites the process of school enrollment in the United States.

6. Enables the process of legal adoption in the United States if an American step-father desires to adopt his wife’s child.
